Terms of Service

Preview policy. This page is a working draft for the TrackSwap demo and is not a finalized legal document. It has not been reviewed by counsel and should not be relied on. It will be replaced before any real launch.

1. The marketplace

TrackSwap is an online venue that connects independent buyers and sellers of used and new racing parts. TrackSwap is not the seller of items listed by users and is not a party to transactions between users, except as the payment facilitator described below.

2. Payments and payouts

Payments are processed by Stripe, Inc. Sellers must complete Stripe Connect onboarding to receive payouts. Listing is free; TrackSwap charges sellers a service fee on the item price of completed sales, tiered by sale price: Under $100 (10%), $100 – $499.99 (7%), $500+ (5%). An estimated payment-processing fee (2.9% + $0.30) applies on top. TrackSwap does notprovide escrow services and does not guarantee that funds are held in trust. Payout timing is governed by order fulfillment and Stripe's processing schedule.

3. Disputes and cancellations

An order that hasn't shipped may be cancelled by either party. Once payment has been captured, either the buyer or seller may open a dispute on an order (non-delivery, item not as described, damage, wrong item, or an unauthorized charge). Opening a dispute pauses that order's seller payout until TrackSwap resolves it. TrackSwap reviews disputes and decides — in its discretion — whether a refund is warranted; this is a marketplace moderation process, not a legal arbitration or chargeback guarantee, and TrackSwap does not promise a particular outcome.

4. Seller verification

A seller may apply for identity verification. An approved application confirms TrackSwap received and reviewed the information the seller submitted — it is not an inspection, background check, or certification of any item a seller lists, and does not guarantee the accuracy of any listing.

5. Prohibited conduct

You may not list prohibited items (see our Prohibited Items policy), circumvent on-platform payments, misrepresent items, harass other users, or engage in fraud. Violations may result in listing removal and account suspension.

6. User responsibilities

You are responsible for the accuracy of your listings, compliance with applicable laws, and the condition and legality of items you sell. Buyers are responsible for confirming fitment and item suitability.

7. Disclaimers

Items are sold as-is by independent sellers. TrackSwap makes no warranty regarding items and disclaims liability to the fullest extent permitted by law. Racing parts may be used in inherently dangerous activities; you assume all risk associated with their use.

8. Changes

We may update these terms. Continued use of TrackSwap after changes constitutes acceptance of the revised terms.
